A
registration of a trademark
is valid for 10 years in Singapore under the Trade Marks Act, starting from its filing date. The renewal will ensure continuous protection of the owner’s rights by
barring any unauthorized use or duplication of the registered mark.
The Intellectual Property Office of Singapore (IPOS) allows the renewal of a trademark before its expiration. The renewal applications can be filed six months prior to
the date of expiration. The owners need to ensure that they complete the renewal process on time so that protection does not lapse.
Renewal: The renewal process involves the submission of the renewal application using the IPOS online portal with the prescribed fee. If an applicant fails to make a
renewal within the given timeline, he will have a six-month grace period for the same with an additional assessment of late fees.
Failure to do so within the period of grace means the removal of such trademark from the register. Any lapsed trademark is restorable by a formal application for
reinstatement with sufficient cause for delay, but such reinstatement is wholly at the discretion of IPOS.
Trademark renewal is important in business to retain intellectual property rights.
